City Council Meeting Notes 1-3-06

6:30pm City Council Chambers

The Council was in attendance with the absence of Julie Woodall.  Before the meeting began, Mayor Leonard offered Thanks to the "50 or so" people that helped out during our local weather emergency.  The meeting then commenced with roll call and the Pledge of Allegiance.  The Council then passed the consent calendar as a block with an unanimous vote.  See the Agenda posted for this meeting for the specifics of the consent calendar. 

The Council next addressed a special Proclamation regarding the local severe weather and flooding emergency.  City Manager Jay Parrish introduced a slide show presentation of various sites around the city and the damage they sustained.  The slides were narrated by Jim Hale of Public Works and the photos are available for the public to view at City Hall.  They are very impressive and you should see them if you are able.  The slides showed the damage to the culvert which failed over in the Bellevue area.  The people from Public Works, the Volunteer Fire Department as well as Wendt Construction worked very hard all over the city dealing with these types of problems as they arose.  The Wastewater Treatment facility was completely flooded and there was sewage backup into some homes.  There was a residence up on Monument that was being slammed with flood water as the culvert above them failed.  Council Member Marc Barsanti and the people from Public Works took the equipment to the property necessary to divert the water away from the home.  The Public Works department is working to assist with the clean up at the Rivers Edge RV Park which was flooded.  There was a large land slide in the bluffs along the river looking upriver from the bridge.  The slides also showed the hard work done by the Red Cross Volunteers who opened the shelter at the school and provided meals and lodging.  This shelter handled Southern Humboldt and those assisted included county residents and travelers passing through our area and stranded.  Hale stated that the Red Cross workers were skilled, professional and knew exactly what they needed to do.  (My family knows two of the volunteers and they are indeed very giving and caring people who dedicate a lot of time and work for the betterment of their community)  City Manager Parrish then read the Official Proclamation and the Council passed this unanimously.

Special Call Items were next with pay request number 5 for John N. Petersen in the amount of $131,013.10 for the raw water intake project.  The motion to approve was put forth by Council Member Melissa Marks with Mike Dunker as second.  The item passed unanimously.  The second item in this category was listed on the agenda as "Authorizing Investment of City Monies in Local Agency Investment Funds (LAIF)."  This was explained by Accounting Supervisor Gordon.  The city invests "temporarily idle funds" and they needed to update the existing resolution to reflect the recent personnel changes.  This then adds Accounting Supervisor Gordon and City Manager Parrish for the purpose of access to and control over the funds.  The motion to approve was made by Dunker with Marks as second and passed unanimously.

Next came the Public Presentation section.  In order to not be accused of twisting the truth, I will post the following presentation verbatim.  A copy of the tape recording or printed transcript  is available upon request from sharon@riodelltimes.com

Sharon:  Sharon Wolff 3 Painter St., first of all those pictures were amazing.  That was really something. the emergency, everyone working real hard on that.  That is incredible, the power of mother nature is an amazing thing.

 In any case,  I have spoken to you repeatedly about the first time homebuyers program.  And the experiences we have had with it.  This is the latest, somewhat related to that.  We have asked you’re the city for help previously for many times and we continue to not get any help. We have a situation where one of the people involved in the Grand Jury complaint um decided to begin a campaign of harassment.  This is a City person um I have spoken previously, I will not mention any names.  Do not worry.  But it is a city employee, it’s the building inspector.  Um this person is ap…(interrupted)

 Mayor Leonard:  you are (inaudible).  I believe this thing has already been settled.

 Sharon:  Oh, no.

 Mayor Leonard:  why are we beating at it again?

 Sharon:  It’s not been settled at all.

 Mayor Leonard:  what’s your problem lady?

 Sharon:  my problem is that my children have been followed home from school (interrupted)

 Mayor Leonard:  Aw, come off of it now

 Sharon:  Excuse me, Mayor Leonard?  My children…(interrupted)

 Mayor Leonard:  Now what a minute,  who has a , who has a restraining order against your husband. 

 Sharon:  Thank you for bringing that up.  The building inspector…(interrupted)

 Jay Parrish:  Remember this is not the place for personal attacks

 Sharon:  No, it is not.  No, it is not.

 Jay Parrish:  And no names will be mentioned. 

 Sharon:  I agree.  As part of the restraining order against us saying that we are harassing this person is a picture of my husband in our front door on our property, a year and half ago.  (showing photo to Council).  He is waving…(interrupted)

 Marc Barsanti:  Could she stay over there?  (indicated podium)

 Sharon:  Sure.  (at podium)  He is waving with one finger, I would have too since this was the eighth picture taking drive by that particular day.  We’ve made police reports about constant picture taking.  This is one of my daughter (showed photo to Council from podium) chasing him off our property.  On our property!  This is serious stuff.  Our children, followed home from school.  Now, Bud Leonard, I know you want to interrupt me however

 Mayor Leonard:  (inaudible)

 Sharon:   I have filed police reports.  They were documentation only on this, for whatever reason.  But can you imagine if your children, if your grandchildren, if they were being followed home from school by someone who has taken their picture, done gun motions at them.  And this is all recorded with the police department, they know all about it.  You’d be very concerned.  Anyone would be.   You would do whatever you needed to, file the correct reports, which we have.  And ask for help!  Which we have.  It is documentation only.  I think is it important that the citizens of Rio Dell realize that children are being followed home from school.  Nothing is being done about it.  Perhaps if someone else was following the children from school, perhaps something would have been done about it.    In any case, we will be pursuing it through our channels.  Now, I will say, I filed a written report.  Chief Hill did confirm it has been accepted, it has been filed.  I appreciate that.  Thank You.  And I’ll be getting a copy of that so, I do appreciate that.  Thank you very much for doing that, for confirming that to me.

 Mayor Leonard:  Is there anyone else who would like to speak?

 Mrs. Kemp:  My name is Kathryn Kemp, I live at 1036 Riverside Dr Rio Dell California.  And um I am speaking in response to Mrs. Wolff and her lies.  We have a restraining order against her husband, signed by Judge Brown.  Um, they presented their side, my husband presented his side, the Judge chose to believe that we are telling the truth and that they have been telling a pack of lies for a year and a half and I just want everybody to know that’s whats’ been going on.  They turn every bit of their harassment around.  To look like they are victims.  They feel that they are victims because of who knows when.  They bought some sort of house, they have some sort of problem.  But I just want everyone to know, she is telling a pack of lies and the Judge found that to be true.  Thank you.

(A personal note-we will be posting the entirety of the restraining order filed against my husband as well as the response I filed and supporting documentation.  Judge Brown stated that we had not submitted a response to the temporary restraining order because the court clerk had stapled all of the papers together into a packet.  I have the complete transcript from Court posted here.  I couldn't make this stuff up if I tried! We have nothing to fear from the truth and leave it up to you to decide)

A citizen spoke of the drainage situation at their home in the Belleview area.  The underneath of their home had been flooded recently and they were concerned about the progress of the drainage study that has been discussed previously.  The flooding under their home as well as the drainage issues in the Belleview area have been long term and need a resolution.  Public Works Director, Jim Hale reassured the citizen that the issues are being addressed as soon as possible as they are well known. 

Another citizen gave the Council an update on the "nuisance abatement" issue they were dealing with.  They are working hard to correct the issues and came to the Council to show good faith and keep all the parties up to date.  The Council acknowledged the difficulty in cleaning up anywhere due to the extreme weather.
